The parties agree as follow:


  • Contracts/Agreements:  All verbal, electronic, and written agreements or contracts between the Patron and the Artist are acceptable, and binding once initiated, and completed.
  • Copyright:  Artist reserves the common-law copyright to all works commissioned by Patron, and original works, that are created by the Artist, including all reproduction rights and the right to claim statutory copyright.  The Patron may reproduce no work without the prior written approval of the Artist.
  • Payment Amounts:  The parties for the individual artwork will decide selling price.  Fee will be based upon size, and complexity of completed work.  Parties will agree to price in writing prior to the commencement of the artwork.  The Artist and Patron will mutually determine size.  All shipping to the Artist and from the Artist are incurred by the Patron.  Shipping charges may include packing materials, insurance, and more expensive shipping options if the Patron requires expedited shipping.
  • Payment Terms:  A nonrefundable deposit of one-half of the selling/shipping price is required before work commences.  Payment in full to be made before the artwork is shipped.  Payment in full may be made by the Patron upon completion of the contracted work, or the Patron may choose to make full payment at the commencement of the contract and work.  In the event damage occurs while the work is en route to its final destination, all insurance claims will be managed and completed by the Artist.  If a Patron is shipping any materials to the Artist, and damage occurs, it will be the responsibility of the Patron to manage and complete all claims, and to manage and replace said materials.
  • Forms of Payment:  Acceptable forms of payment included Credit Cards, and Bank/Teller Checks.  Personal and Business checks will not be accepted.  Credit Card transactions process through Square, and all major credit cards are accepted.
  • Commissioned Artwork:  Patron is commissioning a work of art created by the Artist.
    Right of Refusal: It is the intent of an agreement or contract that the Artist creates artwork for the Patron and that the Patron will purchase the work.  However, if after the work is completed, the Patron does not wish to purchase the work, the Patron may refuse the created artwork.  In that case, the Artist will retain the refused artwork and the nonrefundable deposit, free of any claims or interests of the Patron, and the Patron will owe no additional fees to the Artist.​  At any point after the commencement of the work, and upon completion, Copyright, Payment Amounts, Payment Terms and Forms of Payment are applicable and binding.
  • Original Artwork:  A Patron wishing to purchase artwork created by the Artist (not commissioned) is subject to all Copyright, Payment AmountsPayment Terms, and Forms of Payment as listed above.
  • Variables:  Any deviations from any part of the above information may be made by a Patron and the Artist.  Although individual arrangements may be made at any time, for any project, for any reason between a Patron and the Artist, stipulations listed in the above paragraphs may/will still apply.  Protection to the Artist, the Artist's creative process, and the common-law copyrights to any work will take precedence.   In the end, a lifetime, or lifetimes of appreciation for any of the Artist's work is of the utmost importance.
